Rental Terms & Conditions

If you don’t understand any of the following clauses, ask our staff and we will explain it to you.

1. 1.

   The price has to be paid in full and in advance. Once payment is processed, this Agreement is valid and the vehicle is reserved for the Customers for the desired date and package.

2. 2.

   Customers must be at least 18 years old and present a valid, physical driver’s license and ID, or passport - if not from the EU. Between 18 and 23 years old, at least the first lap has to be accompanied by an Instructor, at the price of €49. More laps mandatory at Staff’s own description Passengers must be at least 12 years old or 1,50m high. It is required that safety belts and protective helmets are worn at all times. Windows and sunroof must remain closed. Warning signs and flags must be observed and respected at all times. In case the Customers are excluded from driving the racetrack due to disrespect for the rules, no amounts related to this contract, nor fees or expenses will be reimbursed.

3. 3.

   Vehicles rented on the Basic Package must be returned with a full tank of fuel exclusively with 98 RON petrol and the receipt must be shown to NürbLife by the end of the rental period. Vehicles rented on the Premium Package can be returned with an empty tank of fuel.

4. 4.

   The Customers comply with all Road Traffic Regulations and legal provisions in connection with the rental. The Customers must pay any fines, penalties or similar which are connected with their use of the vehicle. The Customers are not allowed to (1) sublease the Rental Vehicle or use it as a vehicle for hire, (2) allow any other person to operate the vehicle, (3) use the vehicle to achieve maximum speeds or attempts to set lap times, (4) use the vehicle for any illegal purposes and (5) use the vehicle to operate “Taxi Laps” on the Nürburgring Nordschleife during Public Sessions (Touristenfahrten).

   NürbLife attests that the vehicle is in good working condition and has no operational faults. The Customers are aware that they are driving a modified vehicle for the track, which they will have the opportunity to inspect and describe any eventual flaws in the “vehicle pick up” statement in the last page of this contract, before the commencement of the rental period, act that confirms that the vehicle is in good operational condition and has no existing damage.

6. 6.

   During the journey the Customers have to check the vehicle displays, in particular the engine, oil and water temperatures. As soon as the Customers notice any malfunction or suspicion of a problem during the use of the vehicle, they must interrupt the use and the problem must be reported immediately to NürbLife, as continuation can significantly damage the vehicle, with the Customers being liable for any consequential damages. The Customers also undertake to pay any resulting costs due to an over-rev of the motor, by improper gear changes (or similar) that requires the checking of the technical condition of the engine. The costs of checking for such damages must be paid by the customers, even if no damage was detected.

7. 7.

   The vehicle must be used appropriately and the Customers agree to return the vehicle in the same condition as received, with exception to normal wear-and-tear. Traction and stability systems must remain on all the time. The curbs on track cannot be used, under payment of a repair such as change of parts and alignment. If the tires are worn beyond the expected normal wear, especially after driving with reduced stability systems, or by doing burnouts, drifts, powerslides, launch control or any similar conduct, the extra wear will be charged and is due by the Customer. It is forbidden to smoke or eat inside the vehicle. NürbLife reserves the right to ban the renter or to prohibit the further use of the vehicle in cases of improper use. Reimbursement of costs for the use of the vehicle does not take place in such cases and the renter must pay any costs for damages caused.

8. 8.

   The car is rented only for its use on the Racetrack. The Customers have 22 kilometers or 25 minutes in total with the car per booked lap. In case of a delayed return a fixed fee of €50 will be charged. If the Customers are the last renters of the day, the vehicles must always be returned to NürbLife by 19:30 at the latest. Extra kilometers driven on track or outside of it will count as new laps, which have to be paid at the moment the car is returned to NürbLife. On an agreed number of laps or kilometer packages, no reimbursement or credit for unused kilometers within the stipulated time frame will take place, as the car could’ve been rented to other customers. In cases of early closure of the racetrack / event due to third party fault or force majeure where there was no possibility to use the entirety of the booked service, the non-driven kilometers/laps are credited in form of a voucher valid for the next three years or can be reimbursed at 50% of the monetary value. Any sort of voucher is nominal and cannot be transferred to a third party nor can be exchanged for money. If the car originally booked is not available on the date of pickup, the Customers can choose another car of the same or higher value, with eventual price difference to be paid by them.

9. 9.

   The Customers can be required to provide a Security Deposit to be used in the event of damage of the Rental Vehicle. The deposit can be applied according to the Customer’s profile (age, experience on this track, behavior/attitude, language barriers, coming from a non-EU country, booking a top end car, as well as other criteria), at NürbLife’s own discretion, according to the chart below.

10. 10.

    In the event of damage to the Rental Vehicle during the rental period, the Customers accept the following financial liabilities regarding the repair and its administrative costs of the rented car plus other damages caused to third parties – regardless if inside or outside the racetrack, regardless if or if not at Customers’ fault and regardless if the Customers were currently driving the vehicle. The Maximum Excess must be immediately paid by the Customers, and any amount left as Security Deposit can be kept by NürbLife. [10.1] Customers can purchase a reduction of the deductible, which reduces the maximum excess by 50%, being the same amount as the security deposit. Customers can also purchase a Glass and Tire Protection, which covers all damages to the windscreen, windows and tires, excluding cases in which the customer went out of the limits of the track, hitting curbs, grass, gravel and others. The deductible reduction and the Glass and Tire Protection are only valid for one day of driving: If the driving time is spread over multiple days, the deductible reduction must be purchased for all days – and it is only valid for one incident: If customers continue driving after any incident and cause another incident the maximum deductible will be applied. [10.2] Accidents between two cars during Public Sessions (Touristenfahrten) will be analyzed by the Police, who will decide the faulty part. Regardless, the Customers agree in paying the due amount to NürbLife so repairs or the purchase of a new car can succeed. NürbLife will provide support for the Customers to get reimbursed if the police decide the other party was faulty. During most of Trackdays every driver is liable for the car they are driving only, even if faulty or not, meaning the Customers have to pay for any damages caused to the rental car and track damages, regardless of fault, unless stated otherwise by the Trackday organizer. [10.3] The value of any laps not completed as a result of an accident is forfeited and non-refundable, nor can used as compensation or offset against any damages, as the corresponding income is attributed to the company and the interruption results solely from the driver’s actions. [10.4] Once the car has been repaired, NürbLife will provide an invoice with the total sum of costs to the Customers and any differences will be due or returned. An administrative fee of 10% (ten percent) of the total consolidated damage amount will be charged for the repairs. If the total costs exceed the amount paid, the Customers will be responsible for completing the remaining to NürbLife, up to the Maximum Damage Excess listed on the chart above. The Maximum Damage Excess amount also must be paid immediately in case of an evident total loss or major structural damage. [10.5] If the due amounts are not paid in 14 days from the submission by NürbLife, a penalty of 10% and 1% interest per month of delay will be applied, and the customer is also liable for the loss of profits. [10.6] The Customers do not acquire ownership of the vehicle or of individual vehicle parts upon any payment, as even the Maximum Excess does not cover all costs supported by NürbLife to replace the damaged car. [10.7] In the case of damages that could have been avoided, intentionally caused damages or caused due to negligence, the Maximum Excess does not apply and a complete claim for 100% of all damages is rightful. [10.8] All other costs incurred by the Customers such as damage to the track (guard rails, tire walls, track maintenance fees, card payment fees due to leaving the course, etc.), the use of towing vehicles or damage to third parties (such as other people or cars) must be borne by the Customers and are not included in the Maximum Damage Excess – which is only related to the rented vehicle. The costs must be paid directly and without delay to the operator of the race track or the third party involved. Should further costs related to the incident be received by NürbLife at a later date, the Customers undertake to reimburse these costs in 14 days upon submission of proof, and to pay a penalty of 10% and 1% interest per month of delay. I understand that I am responsible to pay for any damage caused to the rented vehicle, to the track (e.g. guardrails/barriers), to other vehicles or persons affected and for eventual recovery costs - even when a guide is present in the car or driving the car. [10.9] After an incident or accident, NürbLife reserves the right to decide, at its sole discretion, whether the Customers may continue driving. If continuation is permitted, it may be required that the Customers continue driving only under the supervision of an instructor, at the Customers’ expense. NürbLife may also impose additional conditions or restrictions to ensure safety. No right to continue driving is guaranteed.

11. 11.

    The Customers are responsible for their own insurance, for any risks associated to the vehicle rental and for all damages caused to third parties, such as other drivers, pedestrian, instructors, passengers and furthers, for which the Customers agree to release and to indemnify NürbLife from any indemnity, refund or legal action regarding NürbLife or third parties for any damages, injuries, property loss, or death caused during the Customers operation or use of the rented vehicle. This includes cases where the instructor/guide has to assist in the driver controls (e.g. adjustment of the steering wheel in an attempt to avoid an accident) or cases when the guide is driving the rented vehicle. All the above also applies in case of privately owned vehicles. NürbLife accepts no responsibility for damages to the Customers’ private vehicle when providing guidance laps, which is taken at their own risk. In the event that any third-party claims arise in connection with the participation of the Customers, the Customers explicitly releases NürbLife, their representatives and the various agents, as well as the operator of the racetrack and his agents and assistants, from any liability, being this contract proof of it.

12. 12.

    Customers are aware of the use of cameras inside the rented vehicle for safety and security and agree that the footage will be analyzed in any incident. The consent also includes photo, sound and film recordings, which NürbLife is entitled to use free of charge for advertising purposes. Technical failure of video recording equipment leading to a loss of video entitles the participant for a refund of the video service if booked, but for no other claim or indemnity. If the Customers prevent the camera system from functioning (which functionality is verified at the beginning of the rental period), they are responsible for any damage found in the vehicle after the rental period, since it cannot be attested how they occurred. The Customers are liable for omitted or hidden damages caused to the vehicle, even after finished driving, if they are further discovered and proven by NürbLife. Customers shall have no right to access or receive any accident footage. If onboard video is purchased, only footage recorded prior to the accident will be provided.

13. 13.

    Cancellation Policy

    Cancellation Policy - The booking deposit of 30% will be kept in all cases. If a 100% of the booking was paid in advance, following rules apply: Cancellations done before 28 days prior to the booked date of driving will be refunded in 70% of the total. Cancellations done between 28 and 14 days prior to the booked date of driving will be refunded in 50% of the total. Cancellations done between 14 and 7 days to the booked date of driving will be refunded in 20% of the total. A reduction of the booked number of laps is not possible. The reserved vehicle is blocked for a period that is directly proportional to the number of laps booked. Therefore, reducing the number of laps after the reservation has been confirmed is not permitted. Gift Vouchers or Promotional Vouchers are non-refundable, cannot be canceled and cannot be exchanged in money. The refunded amounts specified above exclude any fees related to third party services, such as Trackday slots or driving instruction, as those are booked in advance and have to be honored and will be lost. Up to 14 days before the scheduled date for the driving, customers have the right to reschedule the date of driving with the remaining amount within the following three years from the original date of driving. This does not reset the number of days prior to the rescheduling date, for rescheduling or reimbursement purposes. In the event of a future cancellation, the number of days between the rescheduling and the original date of driving or the newest cancellation in relation to the rescheduled date, whichever is less, will be considered.

14. 14.

    All events take place regardless of the weather conditions. NürbLife reserves the right to change or to cancel the event in case of force majeure or extraordinary circumstances, such as on the instructions or determinations from the circuit management and/or the operator of the race course, (e.g. closure of the track or change of the track opening times), as well as an official order from the government or any other public entity. This does not result in a claim for damages or expenses against NürbLife. For all terms of this contract, force majeure is understood as any circumstances that may cause failure or delay in the performance of the party’s obligations arising out of or caused by, directly or indirectly, forces beyond its control, including, without limitation, strikes, work stoppages, accidents, acts of war or terrorism, civil or military disturbances, nuclear or natural catastrophes, diseases, epidemic, pandemics or outbreak of widespread illness, acts of God, and interruptions, loss or malfunctions of utilities, communications or computer (software and hardware) services; being also understood that NürbLife couldn’t have reasonably foreseen or provided against those circumstances, and shall use reasonable efforts to resume performance as soon as practicable. In these cases, you acknowledge and agree that the experience can be changed to another date, at your choice, in the following three years after the original date of driving, and that no refund nor financial compensation can be charged from NürbLife.

15. 15.

    A penalty ranging from 100€ to 1000€ will be applied in any case of failure to comply with any of the terms of this contract, especially regarding the rules while in possession of the rented vehicle.

16. 16.

    The exclusive place of jurisdiction is the registered office of NürbLife e.K., governed by the law of the Federal Republic of Germany. The Customers are aware that in the event of any dispute over this agreement, this Car Rental Agreement will be interpreted by the laws of Germany, and any lawsuit or arbitration must be brought to this jurisdiction – Amtsgericht Koblenz. If any portion of this agreement is found to be unenforceable by a court of competent jurisdiction, the remainder of the agreement would still have full force and effect.

17. 17.

    This Car Rental Agreement constitutes the entire agreement between the NürbLife e.K. and the Customers. Further agreements are required to be in written form to be valid. The Customers have read all the terms and conditions of this agreement and declare to comply with all of them and also to comply with all conditions and rules of the operator of the race course in connection with their participation. The Customers declare complete capacity to read and understand all the terms of this contract written in the English language.
